Monopoly, register, penalty

The law in one paragraph

The Gambling Act of 2009 puts online gambling under a state monopoly in art. 5 ust. 1b, with betting and promotional lotteries as the only exceptions; the monopoly is exercised by Totalizator Sportowy through Total Casino, the one casino with a Ministry of Finance licence. Art. 15f gives the Minister of Finance a public register of domains used to offer gambling contrary to the act: internet providers must drop a listed domain from DNS within 48 hours and redirect visitors to a Ministry notice page, payment providers must stop serving it within 30 days, and the Ministry counts over 55,000 entries with about 700 new domains a month. For the player the exposure is written in two places: art. 89 ust. 1 pkt 6 of the act sets an administrative penalty of 100% of the winnings, not reduced by the stakes paid, and art. 107 § 2 of the Fiscal Penal Code adds a fine of up to 120 daily rates for taking part in a foreign gambling game from Polish territory. A daily rate runs from one thirtieth of the minimum wage to 400 times that amount, so at the current 4,806 PLN minimum wage the floor of the scale is 160.20 PLN per rate and the court picks the figure by the offender's income.

One sentence to keep

An offshore casino holds a licence somewhere else and none in Poland. That is the whole legal position; the guides below spell out the register, the tax and the payment rails without softening it.

What a Polish player checks first

BLIK on the deposit page

Not in the footer logos, on the deposit page after login. BLIK exists only in Poland, so a cashier that shows it was built for Polish traffic. Since the block that went live at the start of September, BLIK also checks the domain of every payment against the Ministry register before it reaches your bank app; a listed domain fails silently, an unlisted one works as before. A balance kept in zloty

A PLN account means no conversion on the way in and none on the way out. Brands that only offer EUR make you pay the card or Revolut exchange twice; the zloty accounts page lists the ones that do not.

Polish in the chat, not only in the menu

A translated menu is cheap; a support agent who reads a Polish ID card and answers in Polish is not. We mark the interface on the card and name the chat language in each review.

The domain and the register

Which online casino is legal in Poland

Only Total Casino, run by Totalizator Sportowy under the state monopoly of art. 5 of the Gambling Act. Every other casino a Polish reader can open is offshore: licensed elsewhere, unlicensed in Poland, and liable to land in the Ministry of Finance domain register.

Does BLIK still work at offshore casinos

It depends on the domain, not on the casino. BLIK now checks the domain of every payment against the Ministry register before authorisation; a listed domain never reaches your bank app, an unlisted one does. The BLIK page explains what the cashier shows in each case.

Do I pay tax on winnings from an offshore casino

The exemption for slots and table games in the PIT act covers only operators licensed in an EU or EEA state, so a Curacao or Anjouan licence is outside it. The tax guide walks through the 10% rate, the 2,280 PLN threshold and what applies to which licence.
